These Terms & Conditions govern your access to and use of phuketfund.com (the "Site"), operated by Phuketfund Co., Ltd. ("Phuketfund", "we", "us"). By using the Site you accept these Terms in full.
1. Operator
Phuketfund Co., Ltd., a private limited company incorporated in 2018 in the Kingdom of Thailand, company registration number 0835561008217, registered office at 112/24 Moo 4, Wichit Sub-district, Mueang Phuket District, Phuket 83000, Thailand.
2. Purpose of the Site
The Site presents general information about a residential property participation programme operated by Phuketfund across Thailand. The information published on the Site does not constitute an offer of securities, financial advice or a solicitation to invest. No legally binding obligation is created by browsing the Site.
3. Eligibility
The programme is open to natural persons aged between 40 and 65 (born between 1960 and 1985 included), legally capable of entering into a private agreement under Thai law. Phuketfund reserves the right to verify eligibility before sharing project documentation.
4. Risk acknowledgement
Participation in residential property projects involves risks, including the possible partial or total loss of invested capital. Periodic distributions are subject to the progress and conditions of each project. Past performance does not guarantee future results. Phuketfund is not a bank and does not offer deposit guarantees. This Site is not regulated by the Securities and Exchange Commission of Thailand (SEC) or the Bank of Thailand (BOT).
5. Intellectual property
All content on the Site (text, photographs, logos, illustrations, source code) is the property of Phuketfund or of its licensors and is protected by the Copyright Act B.E. 2537 (1994) of the Kingdom of Thailand and applicable international treaties. Any reproduction, representation or adaptation, in whole or in part, without prior written authorisation is prohibited.
6. Personal data
Personal data collected through the Site is processed in accordance with our Privacy Policy and the PDPA. You may exercise your data protection rights by writing to privacy@phuketfund.com.
7. Hyperlinks
The Site may contain links to external websites. Phuketfund has no control over such sites and assumes no responsibility for their content or for any consequence resulting from their use.
8. Availability
We make reasonable efforts to keep the Site available at all times, but we do not guarantee uninterrupted access. The Site may be suspended for maintenance, security or update operations without prior notice.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the competent courts of Phuket, subject to any imperative provision to the contrary.
