Privacy Policy
This Privacy Policy describes how Phuketfund Co., Ltd. ("Phuketfund", "we", "us") collects, uses, stores and discloses personal data of visitors to phuketfund.com (the "Site") and prospective participants of our residential property participation programme. It is issued in compliance with the Personal Data Protection Act B.E. 2562 (2019) of the Kingdom of Thailand ("PDPA").
1. Data controller
The data controller is Phuketfund Co., Ltd., registered office at 112/24 Moo 4, Wichit Sub-district, Mueang Phuket District, Phuket 83000, Thailand, company registration number 0835561008217. For any privacy-related request you may contact our Data Protection Officer at privacy@phuketfund.com.
2. Personal data we collect
We collect (i) data you provide voluntarily through the newsletter form (full name, email address); (ii) technical data automatically generated when you visit the Site (IP address, browser type, device type, pages viewed, referrer, timestamps); (iii) data resulting from your cookie preferences. We do not knowingly collect data from individuals under the age of 18.
3. Purposes and legal basis
We process your personal data to (a) reply to your request and send you the programme details (performance of pre-contractual measures); (b) operate, secure and improve the Site (legitimate interest); (c) comply with our legal obligations under Thai law (legal obligation); (d) where you have consented, send you commercial communications about active residential projects (consent).
4. Retention
Newsletter submissions are kept for thirty-six (36) months from the date of the last contact, after which they are anonymised or deleted. Technical logs are retained for ninety (90) days. You may at any time request earlier deletion.
5. Disclosures
Your personal data may be disclosed to (i) staff of Phuketfund bound by confidentiality; (ii) service providers acting as processors (hosting in Singapore region, email delivery, analytics); (iii) Thai public authorities upon legitimate request. We do not sell your personal data.
6. International transfers
Some processors are established outside Thailand. Transfers are protected by appropriate safeguards, such as data processing agreements containing the standard contractual clauses approved by the Personal Data Protection Committee of Thailand.
7. Your rights
Under the PDPA, you have the right to access, rectify, port, restrict, object to and request the deletion of your personal data, as well as the right to withdraw your consent at any time. To exercise these rights, please write to privacy@phuketfund.com. You may also lodge a complaint with the Personal Data Protection Committee Office.
8. Security
We implement technical and organisational measures appropriate to the risk, including TLS encryption in transit, access control on a need-to-know basis, and periodic security reviews.
9. Changes
We may update this Privacy Policy from time to time. The version in force is the one published on this page, with the date of the last update indicated above.
